Royal Decree 99/2011, of 28 January, which regulates official doctoral teaching, states that all approved theses must be deposited in a repository and be open access. Nevertheless, exploitation rights transferred to publishers must be respected.
As a result, you must have the exploitation rights in order to disseminate a thesis by collection of articles in open access, either because you have kept them as the author or because you have permission from the publisher. Be sure to ask for permission, indicating that it is for a thesis by published works, if the journal's policy is not to allow dissemination. You should also take into account possible embargo periods, i.e. the time between publication and open access. Embargoes should be indicated in the thesis management application.
